STEWART, Circuit Judge:

Jack Donald Egerton, Jr. (“Egerton”), a Texas state prisoner, appeals the district court’s dismissal of his 28 U.S.C. § 2254 petition as time-barred. For the reasons stated below, we vacate the district court’s dismissal and remand for further proceedings in accordance with this opinion.

FACTUAL AND PROCEDURAL BACKGROUND

This appeal is the culmination of two previous grants of certificate of appealability (“COA”) by this Court. The underlying facts are as follows: Egerton pled guilty to aggravated robbery on February 12, 1996, and was sentenced to 20 years imprisonment.…
