INLictmeNt against James Fritz, beard by Judge B. F. Long and a jury, at August Term, 1903, of tbe Superior Court of McDowell County. From a judgment of guilty on a special verdict, the State and tbe defendant appealed.

Tbe defendant and one Hollifield were indicted under Tbe Code, section 1012, in that tbey “Did unlawfully and wilfully send and accept challenge to figbt a duel, and did figbt a duel.” Fritz alone was on trial.

Tbe jury returned tbe following fact found as a special verdict: “That in January, 1903, tbe defendants bad a figbt on Sunday on Buck Creek, McDowell Cbunty; that on tbe night before tbe figbt Fritz came to John Padgett’s bouse where Hollifield was and said be would figbt Hollifield, offered to figbt him then, but said be would meet him anywhere and figbt fair.
