For the purpose of the motions in this case the following facts as alleged in the complaint and affidavits, are pertinent:
The Osteopathic Hospital Association of Delaware, hereafter called “defendant”, was desirous of remodeling the building known as the Sellers Mansion into a hospital building. Plaintiff was president of its board of trustees from 1949 until his resignation on May 22, 1953.
