WELLFORD, District Judge.

This cause came on to be heard upon the complaint and upon the attached affidavits of plaintiffs and others, employees or prospective employees of plaintiffs, proposing to do or doing business at 1348 Madison Avenue in Memphis as Gaisha Bath House. The complaint seeks a declaratory judgment that certain Charter provisions or ordinances of the City of Memphis and certain Tennessee statutes are unconstitutional, either on their face or as applied, and also petitions for injunctive relief against continued enforcement or attempted enforcement thereof.
