MEMORANDUM OPINION

HIRAM H. WARD, District Judge.

In this action, the plaintiffs seek to have an ordinance of Cabarrus County, North Carolina, declared unconstitutional. They also request that this Court permanently enjoin the defendants from enforcing the ordinance. In the “Order on Final Pre-Trial Conference”, filed July 21, 1978, (hereinafter Final Pre-Trial Order), the parties agreed that this case presented only matters of law and that the Court could decide it upon the record.
