KANE, J.

Defendant Charles V. Pineda appeals from a judgment of conviction entered on a jury verdict finding him guilty of second degree robbery in violation of Penal Code, sections 211 and 211a.

The facts leading to appellant’s conviction may be summarized as follows: On August 25, 1971, around 1 p.m., two men approached Angelo Buccelli (“Buccelli”), the owner of the Speedy Seven-Eleven Mart at 3070 Senter Road, San Jose, California. One of the men, who later was identified as appellant, demanded that Buccelli empty the money from two cash registers into a brown bag if he did not want…
