This is a proceeding by the respondent, South Carolina State Highway Department, to acquire a right of way for highway purposes over lands owned by the appellant, Jane M. Jeffords, to which both the landowner and the lessees of the property were made parties. The appeal is by the landowner from an order of the Circuit Court denying her motions for an order dismissing the proceedings on the ground that proceedings to condemn the interest of the landowner and the interests of the lessees had been improperly joined in the same cause; and, in the alternative for an order separating…
