Pending before the Court is Defendant Total Fina Elf S.A.’s (“TFE” or “Defendant”) Motion to Dismiss brought pursuant to Federal Rules of CM Procedure 12(b)(2) and 12(b)(6), and Diamond Chemical Company’s (“Plaintiff’) Motion for Leave to Take Jurisdictional Discovery.
