Error to a judgment of the Law and Equity Court of the city of Richmond, in an action of trespass on the case, wherein the defendant in error was the plaintiff, and the pláintiff in error was the defendant.

On or about the 23d day of December, 1'901, the Standard Oil Company shipped in a tank car about 8,000 gallons of gas naptha from Manchester, and delivered the same on the gasworks siding of the Chesapeake and Ohio Railway Company, in the city of Richmond, under a contract with that city, for use in its gas plant. The tank cars used for delivering the naptha were provided by the Standard Oil Company. Each had a discharge pipe in the bottom of the tank some four inches in diameter, and projecting ten or twelve inches below the bottom. The pipe was threaded to receive and upon it was a cap…
