SHEPLEY, Circuit Judge.

The complainant, on the twentieth day of December, A. D. 1858, executed to Attmore Robinson, one of the defendants, a general assignment of all his property for the benefit of his creditors. The deed of assignment authorized the assignee to take immediate possession of all the property, and “as soon as conveniently may be, by public or private sale, for the best price that can be obtained, convert all and singular the premises into money,’" and to collect all debts due the assignor; and, after paying the expenses oí making the assignment, and of executing the trust…
