Nicholas Apostol was injured when the small plane he was piloting crashed shortly after takeoff at San Juan International Airport in San Juan, Puerto Rico. Claiming that the crash was caused by contact with the wake turbulence of a previously depart ing commercial jet, Apostol sued the United States under the Federal Tort Claims Act. 28 U.S.C. §§ 2671-80. Apostol argued that the airport’s air traffic controller was negligent in allowing insufficient time between the departure of the jet and Apostol’s plane.
