MEMORANDUM OPINION
PAYNE, District Judge.
On November 21, 2004, the Plaintiffs, Donald F. Krane, Cynthia Gay, Michael H. Jones, Bruce M. Wilson, and Eric B. Winfrey, filed the First Amended Complaint (“FAC”), alleging five counts against the Defendant, Capital One Services, Inc. (“Capital One”). Counts One and Two allege that Capital One’s termination of the Plaintiffs’ employment constituted disparate treatment and disparate impact discrimination, respectively, under the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621, et seq.
