Prior to the trial and on August 21, 1911, there was filed in the clerk’s office of Jones county the deposition of one C. W. Hawes, the head clerk of the defendant, taken upon commission in the state of Illinois, for and on behalf of the defendant; and on August 29th of the same year plaintiff filed a motion to suppress this deposition, because the exhibits were not properly returned or identified, and for the further reason that the witness had contemptuously refused to answer the cross-interrogatories propounded to him, and had refused to produce certain papers, files, and documents in his…
