MEMORANDUM OPINION

THIS MATTER is before the Court following a trial on the merits of these con solidated adversary proceedings. Plaintiff asserts that Defendant Timothy Mclntire d/b/a The Bankruptcy Store, LLC (“Defendant” or Mr. Mclntire) 1 is a bankruptcy petition preparer within the meaning of 11 U.S.C. § 110(a)(1) and that Defendant violated the provisions of 11 U.S.C. § 110 by impermissibly giving legal advice to his clients in connection with preparing their bankruptcy petitions, statements and schedules in exchange for a fee of $395.00. 2 Plaintiff…
