Scott D. Warner and his wife, Susan G. Warner, appeal from the trial court’s grant of summary judgment against them and in favor of their neighbor, William H. Brown, on Brown’s claims for trespass. The Warners allege that the trial court erred in finding that Brown owns in fee simple the property on which they allegedly trespassed (the “Roadway”). They base this claim of error on their assertions that: (i) Brown’s chain of title does not support his claim to ownership of the Roadway; (ii) by operation of law, the title to the Roadway vested equally in Brown, the Warners, and an…
