MEMORANDUM OF DECISION AND ORDER ON PLAINTIFF’S MOTION TO ENFORCE SETTLEMENT

DEIN, United States Magistrate Judge.

I. INTRODUCTION

This matter is before the court on Confederate Motors, Inc.’s “Motion to Enforce Settlement.” Docket No. 88. By this motion, Confederate contends that it reached a settlement agreement with the defendant, Francois-Xavier Terny, through attorney emails. Terny denies that a settlement had been reached. The parties have submitted various affidavits, and no one has requested an evidentiary hearing. Oral argument on the motion was held before this court on June 23, 2011.…
