Kapper, J.:

The petitioner seeks a peremptory mandamus order to permit him, assisted by an attorney at law of his selection, to examine, copy and make extracts from the books of the defendant corporation. He bases his claim upon the fact that prior to September, 1919, he was elected, and claims now to be, a director of the respondent corporation. Whether there has been an election of directors since 1919 is not shown.
