NIX, Chief Justice.

The Pennsylvania Department of Environmental Resources (“DER” or “Appellee”), on August 24,1989, filed a Petition for Review, an Application for Special Relief, and a Motion for Expedited Consideration of the Application for Special Relief. In the Petition for Review, the DER asked the Commonwealth Court to declare the Regulatory Review Act, Act of June 25, 1985, P.L. 633, as amended, 71 P.S. §§ 745.1-745.15, unconstitutional and to direct the Legislative Reference Bureau (“LRB”) to publish regulations adopted by the Environmental Quality Board (“EQB”), which the…
