RESTANI, Judge:
In National Customs Brokers v. United States, 13 CIT —, 723 F.Supp. 1511 (1989) {NCBFA I) the court denied plaintiff, National Customs Brokers and Forwarders Association, Inc.’s (NCBFA), motion seeking a preliminary injunction in this matter. The facts relevant to this dispute are set forth in detail in that opinion.
