Plaintiff, Energy Jet, Inc., commenced this action to enjoin Defendant, Forex Corporation [Forex], from using the trademark “Energy Jet” on air replacement ventilation systems and to otherwise enjoin Forex from infringing upon its trademark which is registered to Energy Jet, Inc. in Canada and in the United States. 1 Forex counterclaimed, asserting that Energy Jet, Inc. is not the owner of the disputed trademark.
