MEYER, Justice.
The record discloses the following facts pertinent to this appeal: The victim, Geraldine Abbott, lived with her thirty-year old mentally retarded daughter, Susie Abbott. In response to a telephone call from Susie, the victim’s son arrived at his mother’s home shortly after 2:30 a.m. on 30 September 1979, where he found his mother lying on the floor. Her underpants were pulled down to her knees. Her nightgown was soaked with blood. She appeared to be dead.
