BRITT, Justice.

Pursuant to G.S. 15A-2000 et seq., this case was tried in two phases: (1) to determine the guilt or innocence of defendant and (2) to determine his sentence for first-degree murder following his conviction of that charge. We will discuss the errors assigned under each phase.

Phase I - Guilt Determination

By his first assignment of error defendant contends that, in connection with the charge of first-degree murder, the court erred in failing to instruct the jury concerning the effect of voluntary intoxication upon the elements of intent, premeditation and deliberation. We find no…
