Presently before this court for disposition is a motion for summary judgment filed on behalf of defendant, Rose Faidley, t/d/b/a The Showboat. Defendant avers that there are no genuine issues of material fact in dispute and that she is entitled to judgment as a matter of law to the claims contained in Counts m, IV, and V of plaintiffs’ complaint. She further claims that she should be dismissed as an additional defendant because her joinder is derivative of plaintiffs’ cause of action.
