—Appeal by the defendant from a judgment of the County Court, Nassau County (Harrington, J.), rendered April 12, 1991, convicting him of murder in the second degree (two counts) and conspiracy in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

The defendant contends, inter alia, that the trial court committed reversible error by not, sua sponte, imposing a sanction on the prosecution due to the destruction of certain preliminary notes prepared by a testifying detective during the interrogation of the defendant. We disagree. There is no…
