Order, Supreme Court, New York County (Shirley Fingerhood, J.), entered on or about October 23, 1989, which granted defendant’s motion for summary judgment only insofar as dismissing the request for treble damages from the complaint, is reversed, to the extent *821appealed from, on the law and on the facts, defendant’s motion for summary judgment is granted in its entirety, and complaint dismissed, without costs.
