—In an action to recover damages for breach of an oral contract, breach of a written contract, quantum meruit, and fraud, the defendants appeal from so much of an order of the Supreme Court, Richmond County (Amann, J.), dated May 24, 1993, as denied those branches of their motion which were to dismiss the complaint, and the plaintiff cross-appeals from so much of the same order as struck his demand for punitive damages.

Ordered that the order is modified, on the law, by deleting the provision thereof which denied that branch of the defendants’ motion which was to dismiss the plaintiff’s fourth…
