The State, with the required permission from the Attorney General, 15 M.R.S.A. § 2115-A(5) (1980); M.R.Crim.P. 37(b), appeals from the judgment entered in the Superior Court (Oxford County, Alexander, J.) after the court vacated the judgment entered in the District Court (South Paris, Sheldon, J.) on David Dean’s conditional guilty plea to the charge of operating under the influence. 29 M.R.S.A. § 1312-B (Pamph.1993).
