We granted certiorari to review the court of appeals' unpublished decision in Ronald Lewis v. The Glemelk Ass'n, Inc., No. 09CA1209, 2010 WL 971691. 1 In this private condemnation proceeding, respondent Ronald P. Lewis seeks to condemn a private way of necessity across land owned by The Glenelk Association, Inc.
