The plaintiff in error on May 28, 1902, while standing on a street in Asheville, N. C., was injured by a rock which struck his leg: He alleges in his complaint that the rock was thrown by a blast discharged on a lot owned by the defendant, Charles McNamee, under whose directions the blasting was negligently, unskillfully, and improperly done.
