INGRAHAM, District Judge.

The case is before the court upon plaintiff’s motion to remand to state court and defendant’s motion to dismiss. Plaintiff landowner, a resident of Harris County, brought suit to quiet title to land, against which defendant asserts a judgment lien, in the District Court of Harris County, Texas, 152nd Judicial District, on September 24, 1959.
