HEALY, Circuit Judge.
Appellant sued in the federal court for Idaho to quiet title to certain lands in that state which had been conveyed to the United States. The United States and Mary Elizabeth Long were made parties defendant. The case is here on appeal from a judgment dismissing tlie complaint on motions of the defendants.
The facts alleged were that in 1935 appellant took possession of the lands under an oral contract to purchase the same from Jerome Long and wife on deferred payments. Long died, and the lands were distributed to the widow, Mary Elizabeth Long. In 1942 the United States…
