Defendant-Appellant Joshua Pillault pleaded guilty to knowingly and willfully communicating a threat by means of the internet, an instrument of interstate and foreign commerce, concerning an attempt to kill and injure individuals and unlawfully damage and destroy buildings by means of fire and explosives, in violation of 18 U.S.C. § 844(e). At sentencing, the district court imposed a six-level enhancement, pursuant to Section 2A6.1(b)(1) of the U.S. Sentencing Guidelines Manual (“U.S.S.G.”), for conduct evidencing an intent to carry out the threat.
