The appellant, city of Abilene, sued R. M. Barnes, Mrs. Alvin L. Barnes, and the surety on their respective bonds, for certain sums of money alleged to have been collected by them and unaccounted for to the city. R. M. Barnes was the city assessor and collector, and Mrs. Barnes was employed in that office at the time of the alleged default. R. M. Barnes and others presented a plea to the jurisdiction of the trial court, pleas of misjoinder, general demurrer, and a general denial.
