In an action, inter alia, to recover damages for breach of contract, the plaintiff appeals from so much of an order of the Supreme Court, Westchester County (Rúdolph, J.), dated November 3, 2006, as granted those branches of the defendant’s motion which were to dismiss the first, second, and third causes of action pursuant to CPLR 3211 (a) (7).

Ordered that the order is affirmed insofar as appealed from, with costs.
