In an action to recover damages for negligence, medical malpractice, and breach of contract, the defendants appeal from an order of the Supreme Court, Queens County (Dye, J.), dated September 11, 2003, which denied their motion to dismiss the cause of action alleging medical malpractice as time-barred pursuant to CFLR 3211 (a) (5) and to dismiss the cause of action alleging breach of contract for failure to state a cause of action pursuant to CFLR 3211 (a) (7).
