This case was tried to the court without a jury. At the close of the testimony, plaintiff and defendant each requested *412the court to make findings, and submitted such as he desired adopted. The court did not, in terms, adopt either, but made findings and conclusions of its own and entered a judgment in favor of the defendant. From this judgment the plaintiff has appealed.
