Appeal from a judgment of the Supreme Court at Special Term, entered December 29, 1978 in Albany County, which granted in part and denied in part petitioner’s application, in a proceeding pursuant to CPLR article 78, to compel respondent to pay petitioner wages alleged to have accrued during a suspension of petitioner’s employment. Petitioner, an Albany Police Department Detective, was indicted for bribe receiving in the sec.ond degree.
