This is a proceeding to discipline petitioner, a member of the New York Bar, for professional misconduct. Of the various charges made, only one survived, viz., the refusal of petitioner to honor a subpoena duces tecum served on him in that he refused to produce the demanded financial records and refused to testify at the gidicial inquiry. Petitioner’s sole defense was that the roduction of the records and his testimony would tend *513to incriminate him.
