— Order unanimously modified and, as modified, affirmed, without costs, in accordance with the following memorandum: Plaintiff brings this action seeking to recover $23,264.70 compensatory damages representing the cost of professional fees and disbursements expended in defending a third-party action occasioned by defendants’ malpractice and fraud. It also asserts a cause of action for punitive damages. The present action was commenced March 15, 1976.
