*42In double tracking its line through Albemarle county in 1916, the Southern Railway Company found it necessary or desirable to change its grades at many points. At North Garden, in said county, there was a considerable dip which the company proposed to take out by making ,a. fill. At this point the public highway crossed, the railroad at grade diagonally at an angle of twenty-two degrees, and it was necessary for the company to make an underpass for the highway.
