— In August, 1919, appellant, defendant below, Toeing the owner of the southeast quarter of section 7, township 8 north, range 23 east, Willamette Meridian, in Yakima county, and some small fractions adjacent thereto, entered into a written contract with the respondents Mast and wife, for tíre sale of the land to them.
