We confront once again the tension between the efforts of the City and County of San Francisco (“the City”) to ameliorate the effects of past discrimination in City contracting processes on disadvantaged groups and the constraints imposed by the Fourteenth Amendment’s guarantee of equal treatment to all citizens, as well as other provisions of state and federal law.
