HALE, District Judge.

In this case the plaintiff seeks to recover damages for personal injuries alleged to have been sustained by him on September 11, 1926, while he was engaged as a laborer in the hold of a vessel from which a cargo of raw sugar was in process of being unloaded while the vessel was moored at a doek in South Boston, Mass. The declaration alleges that, while the plaintiff was in the employ of the defendant and engaged in the hold of a steamship under the control of the defendant, and unloading bags of sugar from the hold, and while the vessel was lying at the defendant’s wharf…
