The defendant in error, the plaintiff below, brought suit against the Queen Insurance Company of America in the Circuit Court of Jackson County upon a fire insurance policy. A trial was had on the issues which resulted in a verdict and judgment for plaintiff, .and defendant sued out writ of error! The declaration is substantially in statutory form, and a copy of the *667insurance policy sued on is attached thereto and made a part of the declaration.
