On September 10, 1986, plaintiff Charles Robert Guess filed a three-count complaint in the circuit court of Coles County against defendants Landex Research, Inc. (Landex), and Edmund J. Brophy. On January 14, 1987, defendants’ motion to dismiss the complaint was allowed. Plaintiff then sought leave to file an amended complaint consisting of five counts.
