MEMORANDUM OPINION
TURK, District Judge.
These two cases, which involve a plaintiff allegedly injured when superheated water erupted from a tower at a paper mill and scorched his back, were consolidated for pretrial proceedings. The two defendants, Sandwell Engineering, Inc. (“Sand-well”) and U.S. Filter Corporation (“U.S. Filter”) 1 have moved for summary judgment against the two plaintiffs, Clarence Jordan and Westvaco Corporation (“West-vaco”).
