Alvey Glen Gale (“Movant”) was convicted of second-degree statutory rape after a jury trial, and this court affirmed his conviction on direct appeal in an unpublished opinion. State v. Gale, No. SD28855, slip op. at 1 (Mo.App.S.D. Dec. 17, 2008) (per curiam).
