This is a legal malpractice claim arising out of a workers’ compensation case in which defendants, Herman Winfree and Charles Winfree, represented plaintiff, Harry Frank Garrett.

On 7 December 1975, plaintiff was injured in a work-related accident when he fell from a roof. As a result of the fall, plaintiffs left knee was broken into fragments. Plaintiff originally entered into an agreement for compensation with his employer.
