MEMORANDUM AND ORDER

WARREN, District Judge.

The plaintiffs commenced this civil antitrust action for treble dámages under section 4 of the Clayton Act, 15 U.S.C. § 15 (1970), alleging that the defendants violated sections 1 and 2 of the Sherman Act, 15 U.S.C. §§ 1, 2 (1970), and section 7 of the Clayton Act, 15 U.S.C. § 18 (1970).

After four years of extensive discovery, summary judgment was granted in favor of the defendants on the claim arising under section 7 of the Clayton Act. 1 On May 3, 1976, a jury was selected and the parties proceeded to trial on the remaining claims. At the…
