Appeal from an order of the Supreme Court (Connor, *942J.), entered November 29, 2004 in Ulster County, which granted defendants’ motion for summary judgment dismissing the complaint.
Plaintiff was employed in the police department of defendant Town of Lloyd in Ulster County, beginning in 1990. In the spring of 2000, the Town Board, consisting of the supervisor and the four individual defendants, established a full-time chief of police position.
